These Conditions may be modified. It is your responsibility to read them periodically, as the conditions in force at the time of using the website or placing an order will be the ones applicable to you.

It is necessary to register to access our services, the user must register by filling out the registration form where you will be asked for personal information that must be updated and conform to reality. At the end of the registration process, the user must accept these GENERAL BOOKING CONDITIONS and our PRIVACY POLICY.

By using this website and/or placing orders through this website you agree to:

RESERVATIONS THROUGH OUR WEBSITE

To make any travel reservations or other services offered by www.viap.es you must select a valid payment method, authorizing us to charge you using the selected payment method.

Any transaction shall be subject to the User reading and accepting these General Booking Conditions. Once you have accepted the terms and conditions applicable to the reservation and purchase of the selected product and made the corresponding payment, we will complete the transaction as soon as possible.

In the event that we are unable to complete the orders placed, we will notify you as soon as possible.

PRICES AND PAYMENT METHODS

 

Payments and reimbursements for all transactions will be made in Euros (EUR). If your credit/debit card is not denominated in EUROS, the exchange rate will be applied by the corresponding bank according to the market exchange rate and may vary from the price indicated on our website.

In the case of package travel arrangements, the price of the package has been calculated on the basis of currency exchange rates, transportation rates, cost of fuel or other energy sources, taxes, fees and other tourist surcharges including landing, embarkation and disembarkation fees at ports and airports if expressly included as applicable on the date of delivery of the pre-contractual information.

Unless otherwise indicated, the program offer reflects prices per person with accommodation in standard double room and economy class flights.

Any variation in the price of the aforementioned elements may result in the revision of the final price of the trip, both upwards and downwards, in the strict amounts of the aforementioned price variations. These modifications will be notified in writing to the traveler. The revision of prices in accordance with the provisions of Article 158 of Royal Legislative Decree 1/2007, of November 16, 2007, which approves the Revised Text of the General Law for the Defense of Consumers and Users and other complementary laws will only take place if the organizer of the trip has expressly reserved this right and has so informed you in the pre-contractual information provided to you prior to contracting.

In no case will the price of the trip be revised upwards in the 20 days immediately prior to the departure date. If the price increase exceeds eight percent of the package price, the traveler may terminate the contract by notifying the organizer.

Payments and reimbursements for all transactions will be made in Euros (EUR). If your credit/debit card is not denominated in EUROS, the exchange rate will be applied by the corresponding bank according to the market exchange rate and may vary from the price indicated on our website.

The payment methods available on our website will be shown during the booking process.

www.viap.es will always use secure means of payment. www.viap.es will not store in its files information regarding the data of the cards used. When using a debit/credit card, the user confirms that the card used is his or her own or has been duly authorized by the owner of the card for its use. Credit/debit card transactions will be subject to a security and validation check by the issuing credit/debit card company. In the event that the card issuer denies the transaction, www.viap.es will not be responsible for delays or cancellations of transactions. When the contribution of funds is made by credit or debit card, the expenses or commissions charged by the payment service provider to www.viap.es will be the sole responsibility of the customer.

ORDER CONFIRMATION

Orders are subject to acceptance by www.viap.es, to the user’s compliance with and acceptance of the GENERAL BOOKING CONDITIONS and to market availability. www.viap.es m reserves the right not to accept the order in the event that the payment information is not approved, or that any other type of incident relating to the General Conditions of Use of the portal is detected. When you make a transaction through our website we may send you a confirmation email that will have details of the transaction. Verify that the details in the confirmation message are correct as soon as possible and keep a copy for your records.

RIGHT OF WITHDRAWAL

The transactions carried out on our website include: trips, activities and tourist services that are contracted directly with different suppliers and tour operators. All of them enjoy the right of withdrawal under the terms and conditions of return that for each product the service provider establishes in the package travel contract or in the purchase of autonomous services in each case and of which you will be aware before accepting payment.

 

OUR RIGHT TO MODIFY THESE CONDITIONS

www.viap.es may revise and modify these Terms at any time.

You will be subject to the policies and Conditions in effect at the time you use this website or carry out each transaction, unless we are required by law or governmental agency decision to make retroactive changes to such policies, Conditions, or PRIVACY POLICYIn this case, any changes will also affect orders previously placed by you.

PROTECTION OF PERSONAL DATA

DISCLAIMER OF LIABILITY

We shall not be liable for any failure or delay in the performance of any of the obligations assumed, when the same is due to events beyond our reasonable control (“Force Majeure Cause”). Force Majeure Causes shall include any act, event, failure to exercise, omission or accident beyond our reasonable control and among others, the following:

(i) Strikes, lockouts or other industrial action.

(ii) Civil commotion, riot, invasion, terrorist threat or attack, war (declared or undeclared) Threat or preparation for war.

(iii) Fire, explosion, storm, flood, earthquake, subsidence, epidemic or any other natural disaster.

(iv) Impossibility of using trains, ships, airplanes, motor transport or other means of transportation, public or private.

(v) Inability to use public or private telecommunications systems.

(vi) Acts, decrees, legislation, regulations or restrictions of any government or public authority.

It shall be understood that the obligations shall be suspended during the period in which the Force Majeure Event continues, and we shall have an extension of time to fulfill such obligations for a period of time equal to the duration of the Force Majeure Event. We will use all reasonable means to bring the Force Majeure Event to an end or to find a solution that will allow us to fulfill our obligations despite the Force Majeure Event.

INTEGRITY

These Terms and any document expressly referred to in these Terms constitute the entire agreement between you and us relating to the subject matter hereof and supersede any prior covenants, agreements or promises made between you and us orally or in writing.

You and we acknowledge that we have consented to the conclusion of a contract without having relied on any representation or promise made by the other party or which could be inferred from any statement or writing in the negotiations entered into by the two of us prior thereto, except as expressly mentioned in these Conditions.

Neither you nor we shall have any remedy in respect of any untrue statement made by the other party, whether oral or written, prior to the date of a contract (unless such untrue statement was made fraudulently) and the only remedy available to the other party shall be for breach of contract in accordance with the provisions of these Conditions.

If any of these Conditions or any provision of a contract is declared null and void by a final decision issued by a competent authority, the remaining terms and conditions shall remain in force, without being affected by such declaration of nullity.

JURISDICTION AND APPLICABLE LAW

The sale is understood to be made in Spanish territory, so that for any interpretative or litigious issues that may arise, Spanish law shall apply and, in case of dispute, both parties agree to submit, waiving any other jurisdiction that may correspond, to the jurisdiction of the Courts and Tribunals of the domicile of the Consumer.
